Here follow a few points of the new antiterrorism bill (n.7/2015) introduced in Italy:

– Longer sentence if the offence related to art 270-quinquies of the penal code (‘Training in activities with intents of terrorism also on an international level’) is committed through internet and telecommunication instruments.

– Longer sentence if the offence related to art 302 of the penal code (‘Instigation to commit the offences exposed in the first and second paragraphs’, i.e. offences against the national and international character of the State) is committed through internet and telecommunication instruments.

– Longer sentence if the offences of instigation to commit crime and apology of crime (art. 414 of the penal code) exposed in the first three clauses of the article are committed through internet and telecommunication instruments.

– Longer sentence – up to two thirds – if the offences of instigation to commit crime and apology of crime concern terrorism offences and crimes against humanity (art. 414, paragraph 4 of the penal code) and are committed through internet and telecommunication instruments.

– Constant updating by the Ministry of Interior of a list of websites used for activities of promotion, constitution, organization, management and financing of associations with intents of terrorism also on an international level or of subversion of the democratic order, as well as the websites used to encourage behaviours with intents of terrorism.

– The possibility for the Judicial Authority to order internet providers to block the access to websites used to commit offences with intents of terrorism and included in the list constantly update mentioned above. In the eventuality the order is not executed the Judicial Authority itself will provide for the interdiction of the access to the internet domains concerned.
