Translated by act for freedom now
On November 14, 2014 magistrates of the fifth section of the Court of
Cassation quashed, with deferment to the Appeal Court of Taranto (owing
to issues of local jurisdiction), the sentence of subversive association
against 12 anarchists from Lecce, investigated in 2005 following
<a
href=”http://turbellaria.blogspot.co.uk/search/label/Lecce%20anarchists”>‘operation Nottetempo’.
All the charges, related to a number of offences, went through the statute of limitations.
In the first grade trial the charge of subversive association (art
270bis) was changed to that of organized crime (art.416) concerning four
of the defendants, while eight of them were acquitted.
Later, in the second grade trial, the Appeal Court of Lecce sentenced
all the defendants for simple subversive association (art. 270). Only
after the motivations of the Court of Cassation are made known will it
be possible to understand what the pronouncement of the Court of Taranto
is intended for.
We want to point out that the charge of subversive association and those
relating to various other ‘crimes’ (instigation to commit a crime;
unauthorized demo; insulting the authorities; arson of the cash machines
of Banca Intesa, the main door of the Cathedral in Lecce and the house
of don Cesare Lodeserto; damage to Esso petrol stations) were related to
the ongoing struggles against the then Regina Pacis migrants’ detention
centre in San Foca (Lecce) and the war in Iraq.
